pokeplus Competition Terms

PART A: Schedule for this draw

The specific details displayed on the applicable giveaway page when entries open form part of this schedule.


1. Competition name	The title displayed on the applicable giveaway page.
2. Promoter	`POKEPLUSCO PTY LTD` (ABN 79 701 573 579) of Sydney, New South Wales, Australia
3. Entry requirements	Entrants must be at least 18 years of age.
4. Number of winners	One winner, unless the applicable giveaway page states otherwise.
5. Territory	Open worldwide, excluding South Australia. Residents of South Australia may not enter or win. Entry is otherwise open to entrants in any country, state or territory, on the basis that each entrant is responsible for satisfying themselves that entering is lawful where they are (see clause 2.2). Any further excluded jurisdiction will be listed on the applicable giveaway page.
6. Promotion period	Opens and closes at the dates and times displayed on the applicable giveaway page, in Australian Eastern Time, or earlier if the stated entry cap is reached.
7. Entry cap	No fixed entry cap unless a maximum is displayed on the applicable giveaway page.
8. Prize	The prize and its estimated retail value in Australian dollars are displayed on the applicable giveaway page. That displayed value is the total estimated prize pool unless the page states otherwise.
9. Draw	Entries are numbered sequentially. The winner is selected at random by RandomDraws, an independent third-party draw platform, at the date and time displayed on the applicable giveaway page, online at the Promoter's place of business in Sydney, New South Wales. The draw is announced live on Instagram and a record of the result is retained.
10. Winner notification	Notified within 7 days of the draw, both by email to the address on the member's account and by a notice in the member dashboard. The result is announced at `www.pokeplus.co` within 7 days.
11. Prize delivery	Dispatched within 5 business days of eligibility being confirmed.
12. How to enter	Hold an active paid membership tier, or buy a one-off Poké Ball package. A daily or flash draw is open only to the membership tiers stated on the applicable giveaway page and cannot be entered with Poké Balls. There is no free entry route. See clause 3.

1. Agreement

1.1 Part A and these general conditions together form the Competition Terms for this draw. By entering, you accept them.

1.2 Our Privacy Policy applies to information collected through this draw.

1.3 Where these Competition Terms conflict with our Terms of Service, these terms apply to this draw.

2. Who can enter

2.1 Entrants must be at least 18 and must meet the entry requirements in Part A.

2.2 Where you can enter from. This draw is open to entrants anywhere in the world, other than South Australia (clause 2.5) and any other jurisdiction excluded in Part A. Wherever you enter from:

(a) It is your responsibility, not ours, to satisfy yourself that entering this draw is lawful in the country, state or territory where you are located, and that you are of legal age to enter there. You warrant that both are the case.

(b) You are solely responsible for compliance with the law where you are. We do not represent that this draw complies with the law of any country other than Australia, and we accept no responsibility or liability for an entrant who enters from a jurisdiction in which entering is not permitted.

(c) You are responsible for all taxes, duties, customs charges, import restrictions, licences and declarations arising in your jurisdiction from entering or from receiving a prize.

(d) We may decline to accept an entry, or decline to deliver a prize, to any jurisdiction where doing so would be unlawful, impractical, or would expose us to regulatory obligations in that jurisdiction. We may also void an entry, and withhold or reclaim a prize, where we become aware that the entry was made from a jurisdiction in which entering was not lawful. Where we decline after a draw, clause 6.6 applies.

(e) To the extent permitted by law, you are responsible for any loss we suffer arising from your breach of this clause.

2.3 Our directors, employees and contractors, and their immediate family members, are not eligible to win.

2.4 One person may hold one pokeplus account. Entering through multiple accounts is a breach of these terms and all entries associated with those accounts may be cancelled.

2.5 South Australia. Residents of South Australia are not eligible to enter or to win this draw, due to regulatory requirements under South Australian law. This applies regardless of prize value or membership tier, and regardless of where else in the world you hold citizenship or residence. The exclusion applies even though this draw is otherwise open worldwide under clause 2.2, and we cannot waive it. An entry made by a South Australian resident is void under clause 2.6 and no prize is payable on it.

2.6 Ineligible entries. If you enter from South Australia, from any other jurisdiction excluded in Part A, or from a jurisdiction in which entering this draw is not lawful, whether by mistake or by giving us an address or region that is not your own:

(a) your entry is void and confers no chance of winning;

(b) if you are drawn, no prize is payable and the draw will be redrawn under clause 5.3;

(d) nothing in this clause limits your rights under the Australian Consumer Law.

2.7 You warrant that the region recorded on your account is the jurisdiction in which you actually reside, and you must update it if you move.

3. Entering this draw

3.1 To enter this draw you must hold an active paid membership tier, or buy a one-off Poké Ball package, during the promotion period. There is no free entry route and a purchase is always required to enter.

3.2 Where you hold an active paid membership during the promotion period, Poké Balls are credited to your account automatically according to your tier and are used to enter this draw, unless this draw is a daily or flash draw (clause 3.6).

3.3 Poké Balls bought as a one-off package are credited to your account on purchase and are used to enter this draw in the same way as Poké Balls credited under a membership. Poké Balls, however credited, can only ever be used to enter a monthly draw.

3.4 Your entries for this draw are those recorded against your account at the moment the promotion period closes.

3.5 If you cancel your membership during the promotion period, entries already allocated for this draw remain valid for this draw.

3.6 Daily and flash draws. Where the applicable giveaway page states that this draw is a daily or flash draw, it is open only to the membership tiers stated on that page. Your entries are allocated automatically according to your tier, either when the draw opens or when you first hold an eligible tier while it is open, and no Poké Ball is deducted for them. Poké Balls cannot be used to enter a daily or flash draw. If you move to a higher eligible tier while the draw is open, your entries are increased to that tier's allocation. If you move to a lower tier or cancel, clause 3.5 applies. You are allocated entries in a daily or flash draw only while your membership is paid up. If a membership payment fails, no new entries are allocated until it succeeds; entries already allocated stand under clause 3.5.

4. How the winner is selected

4.1 All valid entries are assigned a sequential number. The winner is selected at random by the platform, at the time and place stated in Part A.

4.2 Incomplete, duplicated or invalid entries are excluded.

4.3 The draw is conducted live and a record is retained. If you want to understand how a result was produced, contact us and we will explain the process and the record for that draw.

4.4 The prize is awarded to the person named on the winning entry.

5. Claiming the prize

5.1 We will contact you by email at the address on your account, and by a notice in your member dashboard. Keeping your email address current is your responsibility.

5.2 We may require reasonable proof of identity and age before releasing a prize. If you cannot provide it, you forfeit the prize.

5.3 If a prize is unclaimed three months after the draw despite our reasonable attempts to contact the winner, it will be redrawn at 12:00 noon Australian Eastern Time on the first business day after that three-month period, in the same manner and place as the original draw.

6. About the prizes

6.1 Prizes are provided as described in Part A and are not transferable or exchangeable unless we agree in writing.

6.2 We may substitute a prize of equal or greater value where the stated prize becomes unavailable. Where we do, we will announce it before the draw closes.

6.3 Any cost of receiving or owning the prize beyond delivery, including taxes, duties, insurance and ongoing costs, is the winner's responsibility. If the prize may have tax consequences for you, get your own advice.

6.4 Where a prize is supplied or shipped by a third party, the winner's name and address will be given to that supplier for delivery only.

6.5 Prizes are not modified at a winner's request.

6.6 International delivery. Where a prize is delivered outside Australia:

(a) We pay for standard delivery to the address you nominate. Everything beyond that is yours: import duty, GST or VAT equivalents, customs brokerage, clearance, declarations, and any local licence or permission required to receive the item.

(b) Risk passes to you on delivery to the carrier. We are not liable, to the extent permitted by law, for seizure, confiscation, destruction or refusal of entry by customs or any other authority in your jurisdiction.

(d) You are responsible for insuring the prize once dispatched unless we tell you otherwise in writing.

(e) Where delivery to your jurisdiction is unlawful, uninsurable, or would cost more than a proportion of the prize value that we consider unreasonable, we may instead offer a cash equivalent, or ask you to nominate an Australian delivery address.

7. Personal information

7.1 Information you give us for this draw is handled in accordance with our Privacy Policy.

7.2 We share entry and winner information with prize suppliers, delivery carriers, scrutineers, auditors and regulators where necessary to run the draw or to demonstrate that it was run fairly.

7.3 Entering a draw does not subscribe you to marketing. We will only send you marketing if you separately opt in.

7.4 We will publish the winner's display name. Any use of a winner's photograph, likeness, real name or location is by separate consent, which we will ask for and which you may decline without affecting your prize.

8. Anything you upload

8.1 If you submit a photograph or other content as part of a draw, you confirm you own it or have the right to provide it, and that it does not infringe anyone else's rights.

8.2 You grant us a non-exclusive, royalty-free licence to use that content for the purpose of administering and announcing this draw. That licence ends when the draw concludes, except for records we must retain.

9. Our rights

9.1 We may disqualify an entrant we reasonably believe has breached these terms, tampered with the entry process, acted unlawfully, or acted to compromise the fairness of the draw. Where we do, we will tell them why.

9.2 Where the draw cannot be run as planned, because of technical failure, tampering, fraud, or a legal or regulatory requirement, we may modify, suspend or cancel it. We will publish what has happened and how entries are being handled.

9.3 If a draw is cancelled before it is run, Poké Balls used for entries in that draw will be returned to the entrant's pokeplus account. Automatic entries in a cancelled daily or flash draw lapse, since no Poké Ball was spent on them.

10. Liability

10.1 Nothing in these terms excludes, restricts or modifies any right or remedy under the Australian Consumer Law that cannot lawfully be excluded.

10.2 Subject to 10.1 and to the extent permitted by law, we are not liable for entries that are lost, late or not received due to technical failure, network problems or error outside our control.

10.3 Subject to 10.1, our total liability in connection with this draw is limited to the amount you paid us in the 12 months before the claim arose.

10.4 We are not liable for loss or damage arising from the use of a prize, except where that liability cannot lawfully be excluded.

11. General

11.1 These terms are governed by the laws of New South Wales and the parties submit to the non-exclusive jurisdiction of its courts.

11.2 If a provision is invalid or unenforceable it is severed and the rest continues.

11.3 Not enforcing a right immediately does not waive it.

11.4 Clauses 7, 8 and 10 survive the conclusion of the draw.
